In the state, registration of society leases will now not be carried out without land conversion and 90A clearance. The state government implemented the amendment to the Registration Act 2021 from Tuesday, after which work remained stalled in registry offices across the state.
According to the notification, the entire responsibility will now lie with the Sub-Registrar if society leases are registered without conversion and 90A. Consequently, work was minimal in registry offices across the state on Wednesday.
Plot owners must declare land status
At the time of registering a society lease, the plot owner will now be required to state whether the land on which the plot has been bought has been converted or has been included under 90A.
Move aims to prevent illegal land sales
The government’s intention behind this order is to curb the illegal sale of government land, SC-ST land, and agricultural land. Multiple types of disputes arise regarding such land. Under the Tenancy Act, SC-ST land can only be sold to a person belonging to the SC-ST category.
Disputes arising from non-converted SC-ST land
Many societies, after purchasing land belonging to SC-ST individuals, used to create plots on it without conversion. This often led to disputes on those lands. To prevent this, the government has now enforced the amendment to the Registration Act.

BigSauda.com opinion and advisory:
After Rajasthan has become strict with the rules regarding the land conversion and 90A clearance, it has become complicated in choosing the right property. It’s indeed a nice step taken by Govt. of Rajasthan to avoid illegal plotting and land development for habitat. Recently some incidents happed in Jaipur, many people lost their built home due to illegal society mafias, It is highly recommended by BigSauda to put your money only in those residential plots or residential projects that have been legally verified and approved by local authorities.
As we have seen a fast development of residential plotting projects and commercial projects in Jaipur and other big cities of Rajasthan i.e. Kota, Udaipur, Jodhpur, Ajmer and Alwar; one has to be very careful about the legal check of property before putting hard earned money in such property transactions.
